Contributions

2.1 Nature of a contribution
A contribution made through the Site is a voluntary, non-refundable contribution to the Authorising Principal in support of his political activities ahead of the 2027 general election. It is not:
- A purchase of goods or services;
- An investment, deposit, loan, or other financial instrument;
- A charitable donation within the meaning of Companies and Allied Matters Act (CAMA) 2020 or the Companies Income Tax Act 2007;
- An entitlement to any preferential treatment, access, or favour;
- A vote, registration, or pledge of any kind under the Electoral Act 2022.
Contributions are not deductible against any tax liability unless and until the relevant tax authority issues a notice or ruling to that effect.
2.2 Statutory and policy caps
The Electoral Act 2022 caps individual contributions to a candidate at the amount specified in section 88. The current cap is presented to you in the Donation Platform at the moment you initiate a contribution. The Campaign reserves the right to apply a more restrictive cap as a matter of internal policy, and to reduce the cap further at any time.
We monitor cumulative contributions per donor (where the donor has been identified) over the campaign cycle and will refuse contributions that would exceed the applicable cap. Where a contribution that would exceed the cap is received before the cap is reached, the excess will be refunded to the originating wallet less unavoidable on-chain network fees.
2.3 Currencies and payment methods
The Donation Platform accepts contributions in the cryptocurrencies enumerated in the Donation Platform UI at the time of contribution. The list may include, without limitation, BTC, ETH, USDT (TRC20 / ERC20), BNB (BSC) and SOL. The list may change at any time. The Campaign does not directly accept fiat currency through the Site.
Contributions are denominated for accounting purposes in United States Dollars (USD) using the rate quoted by NowPayments at the time the invoice is generated. The denomination in the Donation Platform UI is for your convenience only.
2.4 Invoice and confirmation
When you initiate a contribution, the Campaign generates an order ID (a ULID) and requests an invoice from NowPayments. The invoice tells you the cryptocurrency address and the precise amount to send. The contribution is treated as made when:
- The on-chain transfer reaches the threshold of confirmations specified by NowPayments; and
- NowPayments delivers a webhook with status “
finished” to our endpoint.
Contributions in transit (status “waiting”, “confirming”, or “sending”) are not recognised as accepted contributions and may be reversed.
2.5 Partially-paid and over-paid contributions
Where the on-chain transfer is short of the invoiced amount (status “partially_paid”) or exceeds the invoiced amount, the Campaign will, at its election:
- Credit the actual amount received and treat the contribution as accepted;
- Refund the entire amount to the originating wallet less network fees;
- Hold the proceeds in an escrow wallet pending instructions from the contributor.
The Campaign will choose the option that, in good faith, best reflects the contributor's intention and complies with the Compliance Acts.
2.6 Receipt and recordkeeping
Where you have provided an email address, the Campaign will issue an electronic receipt bearing the order ID and the contribution amount. The receipt is for your records and is not a tax-deductible certificate.
We retain donation records for the periods set out in Privacy — Section 1.5.
2.7 Anonymous contributions
For amounts below the statutory threshold, you may make an anonymous contribution. The amount, currency, and date of the contribution will be recorded in the contribution register and reflected in the relevant transparency report.
For amounts at or above the statutory threshold, anonymous contributions are not accepted. Where such a contribution is nonetheless received, it will be handled as described in Privacy — Section 3.6.
2.8 Conversion of cryptocurrency
NowPayments converts received cryptocurrency to a settlement asset on the Campaign's instruction. The Campaign reserves the right to hold all or part of the contribution in cryptocurrency for liquidity purposes. The Campaign assumes the market risk of conversion and you do not bear any market risk after the contribution is treated as accepted under Section 2.4.
2.9 Taxes and fees
You are solely responsible for any tax that may apply to you in respect of a contribution under the laws of your jurisdiction, and for any blockchain network fees you incur in making the contribution. The Campaign does not provide tax advice.
2.10 Prohibited contributions
You must not, and represent and warrant that you will not, attempt to make a contribution:
- From a Sanctioned Jurisdiction or as a Sanctioned Person (see Eligibility 1.4);
- Using a wallet address that you do not control;
- Using funds derived from any unlawful activity;
- That you intend to recover, in whole or in part, by any means;
- That is designed to circumvent any cap or threshold under the Electoral Act 2022;
- That is intended to obtain any preferential treatment from the Authorising Principal.
