Eligibility

1.1 Age
You must be at least eighteen (18) years of age to access or use the Site. By using the Site, you represent and warrant that you are eighteen (18) or older and have full legal capacity to enter into these Terms.
1.2 Legal capacity
You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction. If you act under a power of attorney or other authority, you must be able to produce evidence of that authority on request.
1.3 Nationality and source of funds
Section 88(2) of the Electoral Act 2022 prohibits political parties and candidates from accepting contributions from non-Nigerian individuals or organisations. You represent and warrant, every time you initiate a contribution through the Site, that:
- You are a citizen of the Federal Republic of Nigeria, or, if a dual national, are contributing in your capacity as a Nigerian citizen;
- You are contributing on your own behalf and not as a conduit for any other person or entity;
- The funds used for the contribution are derived from a lawful source and have not previously been the subject of any laundering, structuring, or other unlawful activity;
- You are not knowingly evading any cap, threshold, or reporting requirement imposed by the Electoral Act 2022 or any other Nigerian law;
- You are not a Politically Exposed Person (PEP) of a foreign jurisdiction whose contribution would be inconsistent with the Electoral Act 2022 or applicable foreign law.
1.4 Sanctions
You represent and warrant that you are not:
- The subject of any sanctions administered by the United Nations Security Council, the Nigerian Sanctions Committee, the United States Office of Foreign Assets Control (“OFAC”), the European Union, the United Kingdom (HM Treasury / OFSI), or any other competent sanctions authority (“Sanctioned Persons”);
- Resident in a jurisdiction that is itself the subject of comprehensive sanctions by any of the foregoing authorities (“Sanctioned Jurisdictions”);
- Owned or controlled by any Sanctioned Person; or
- Acting, directly or indirectly, on behalf of any Sanctioned Person or in any Sanctioned Jurisdiction.
1.5 Entities
Section 88(2)(c) of the Electoral Act 2022 prohibits the acceptance of corporate contributions to candidates. The Donation Platform therefore does not accept contributions from companies, partnerships, trusts, or other legal entities. Any contribution received from a legal entity will be refunded to the originating wallet less unavoidable on-chain network fees, and the Campaign reserves the right to recover from the entity any cost reasonably incurred in identifying and refunding the contribution.
1.6 Public office holders
If you are a public office holder, you are responsible for complying with the conduct rules applicable to your office, including those of the Code of Conduct Bureau, before making a contribution.
1.7 Campaign personnel
Members of the campaign secretariat, paid consultants, and Site administrators may make contributions but must declare their role at the time of contribution.
1.8 Suspension and refusal
We reserve the right, in our sole discretion and without prior notice, to:
- Refuse a contribution;
- Suspend or terminate your access to the Site;
- Refund a contribution to the originating wallet, less unavoidable on-chain network fees;
- Report a contribution to law enforcement or a competent regulator,
where we reasonably suspect a breach of this Section 1, the Compliance Acts, or any other applicable law.
